A former Hooters waitress, Jodee Berry, 26, has sued the chain. She says she was primised a new Toyota (you know, the car) for winning a beer sales contest. Instead, she was awarded a toy Yoda. Jody won a contest to see who could sell the most beer in April at the Hooters in Panama City Beach, FL. The top-selling waitresses from each Hooters in the area were entered into a drawing, and she won. She was blindfolded, led into the resteraunt parking lot, and when her blindfold was removed ... they handed her a boxed Yoda. Not a Toyota. She's suing for breach of contract and fraudulent misrepresentation. She seeks the cost of a new Toyota. Her lawyer is looking at false advertising law.

Most people would take this as a joke. Also, unless the word "Toyota" was actually printed somewhere, I don't think there's really any grounds. If there were only audio ads or word-of-mouth, then there's nothing anyone can really do about it.

Yeah, but you get the feeling that's what they were implying. I mean, leading her into the parking lot ... ? C'mon.

When I first heard this story, I laughed. I thought that it was a pretty good joke; it's something that I probably would have never thought of. However, if I were in that waitress's shoes, I'd be mighty ticked off. From the story that I read, there was a flyer or memo that was circulated that did say "free Toyota."

I don't think the Ferengi ever had to deal with lawsuits...then again Ferengi remind me of the Star Trek version of lawyers. If I were the waitress, I'd sue also for that trick.
