The difference is, this human being is consciously trying to harm you and yours, and is fully capabale of understanding the potential consequences of his actions, while a fetus isn't. So I guess it really depends on how you classify 'human.' In your view, criminals and murders and rapists are human, and unborn children aren't. My view is precisely the opposite. Thus the quandary.
