When I placed the 24 hour ban on political discussions, I was assuming that the Florida Supreme Court would side with the lower courts and find insuffecient cause to overturn any results, or do something much different than they did.

The Florida Supreme Court has ordered that ballots that could not be processed by the machines be manually recounted.

Again.

Of course, the chances of counting tens of thousands of ballots by the 12th is nil.

What are your thoughts?

And please folks, let's not do personal attacks. It's just not nessecary.

Well, it would seem that the Supreme Court is what we thought it was: Gore's lackeys.

Can't wait for the US Supreme Court to come down and spank them again.

The US Supreme court did not fetch brains for Gore.

Therefore the US Supreme court is not a lackey.

Anyway, since, IIRC, it's a violation of federal law to change the rules of an election after the votes have been cast, this will be overturned immediately. Also, it can be challenged on constitutional grounds, in that a court is creating law. Again.

Another possible case, of which I'm not sure, is if it's possible to appeal a violation of state law, if the state SC is the one commiting the violation. Can a federal court handle such a case?

This entire thing is a PR move. There's no way to count the votes in time. The Gore camp is just trying to create what looks like a legitimate count (BTW, it isn't) to make it look like Gore actually won, and thus undermine the Bush presidency.

I have yet to make a dent in their seventy page decision. I'll return with further comments when I've finished.

The state Supreme Court is the final arbitor of state law. I.E. interpreting Florida state law stops at the Florida Court.

However, tf the appellate can make a case that there is a federal law overriding a given state law or a Constitutional reason then the US Court can get involved.

Intresting thought though...if this is a Florida decision or a decision on Florida law, then all the conservative state's rights folks should be very careful about seeking redress in the federal system.

I think it's clear by this point that such issues aren't very important, with Gore's camp suddenly holding up the state as a supreme arbiter and Bush's running to the Federal courts. I really doubt that will change anything re: their overarching political philosophies, though.

You'll notice that the FL SC decision was 4-3, meaning even THEY were divided on the idea. And from what I heard, the senior judge (who voted with the minority) wrote a very-well-written dissent.

Personally, I think this whole thing is another last-minute attempt to steal the election. The votes have been tabulated.. what, FOUR times, now?

The laws set up to limit recounts were created to keep just these sorts of things from happening.

Remember, during all the previous recounts, ballots were scrutinized, poked, prodded, bent, folded, packed, re-packed, ... and possibly punctured. Which means there were ample opportunities for sympathizers to... create... new Gore votes.

Then there's this whole nonsense about determining 'voter intent' on ballots which had holes for minor candidates, but not for president. What crap. No holes poked is a vote for "None of the Above," if anything. A vote for Buchanan is a vote for Buchanan, even IF the voter was so drunk/stoned he/she picked the wrong hole. That's his/her tough luck. Gore should grow up and accept that.

It was James Polk (not certain, but fairly sure), was the last president to win the Electoral College but not the Popular. He was known as "His Fraudulancy" and didn't get much done. George W. Bush was won the Electoral but not the Popular, therefore ...

George W. is the legal president. Doesn't mean he won't be known as "His Fraudulency", however.

If Al Gore does somehow get in, I'm sure he'll be called "His Fraudulency" as well, except for different reasons.

James K. Polk did win the popular vote, actually. While I'm at it, please see this page...he was one of the better presidents, by far.

My bad! Rutherford Birchard Hayes, 19th President of the U.S. of A.

Won 4,036,572 popular votes. His opponent, Sam Tilden, won 4,284,020 ... but Hayes won 185 electoral to Tilden's 184 ...

Don't know why I thought it was Polk ...

Actually, i'm not surprised at all any of this is happening. It goes to show you that we are LONG overdue to seriously start re-thinking how we elect people to the presidency in this country.

None of this would be happening if Gore and the FL Supreme Court were respecting that system. The only reason this has all taken place is because the FL court saw fit to rewrite the law, thus displaying their contempt for it, and for the constitution they were sworn to defend. The problem lies not in the rules. The problem lies in those that ignore them.
